Shop Terms and Conditions

These terms apply to businesses that Bosch Automotive Service Solutions Pty Ltd (ACN 001 091 498) (Bosch) transacts within a business-to-business capacity.

Please read these Bosch EV Charger Online Store (Shop) Terms and Conditions of Use (Terms and Conditions) carefully before using this Shop. By accessing or using this Shop and in consideration of Bosch providing you with access to this Shop, you agree to be bound by and that you have taken note of these Terms and Conditions, as well as Bosch’s Terms of Delivery and Sale and Privacy Policy, which are hyperlinked here, and can be found at www.bosch.com.au/terms. 

If you do not agree to any of these Terms and Conditions, do not use this Shop. This Shop is owned and operated by Bosch.

Licence to Use the Shop 

You may: 

• View the materials in this Shop. 
• Access the materials in this Shop. 
• Use this Shop strictly in accordance with the provisions of this these Terms and Conditions. 

If you wish to download and use any materials contained in the Shop for a temporary purpose (such as viewing offline), you may do so. However, downloading materials contained in this Shop for reproduction may only be done upon receipt of prior written consent from Bosch. 

You must not establish links on any other websites to this Shop without the prior written consent of Bosch. 

Intellectual Property Rights

This Shop contains copyright material, brand names, trademarks and other intellectual property rights that are protected by law. You should assume that all names and logos are trademarks of Bosch, the BOSCH Group or third parties, and that all content on this site is subject to copyright. You must not infringe any of those rights. In addition, you specifically acknowledge that you may not use, reproduce, transmit, adapt, vary, or modify any material in the Shop for commercial use, except as otherwise expressly authorised by these Terms and Conditions or with the express prior written consent of Bosch. In particular, you should note that the logo, ‘BOSCH’ and the symbol are registered trademarks of Robert Bosch GmbH, Germany. The use or misuse of these trademarks except as noted above is strictly prohibited. 

Disclaimer

Subject to any rights that you might have in relation to the statutory consumer guarantees, Bosch: 

• reserves the right to change, add or remove any material in or from this Shop without notice;
• has endeavoured to ensure that all information provided on this Shop is accurate, complete and up to date, but takes no responsibility for any error or omission relating to this information or for its suitability for your purposes; 
• does not warrant that the functions contained in this Shop will be uninterrupted or without error, that defects will be corrected, or that electronic material in this Shop are free of viruses or other harmful components; and
• makes no warranty or representation and accepts no responsibility for any website operated or controlled by entities other than Bosch which may be or become linked or framed to or from this Shop.
  

Use of information

Use of Products

Products purchased from this Shop must not be used for any purpose other than to charge an electric vehicle to the extent that the product is compatible with the electric vehicle in question. Before you or any other person use products purchased from this Shop, professional installation in accordance with product instructions is required. Please ensure you read and understand the instructions and safety information provided before use.

Always ensure EV chargers and their components are in good condition before use. Any worn or damaged parts must be replaced immediately to prevent risks. The use of third-party or unauthorized accessories or components with our products may void the warranty and result in malfunction.

You agree that we are not responsible for the installation or the supervision of use of our products by you or any other person.

Purchasing online

Online Shopping

You are able to shop online and purchase products, which will be billed to your business trading account with Bosch (if you have one) or via credit card. An invoice will be raised once an order has been despatched.

Placement of an order using the Shop is an offer to purchase Bosch products. Bosch may accept your order by organising delivery of the products to your delivery address or may, for any reason (including circumstances where Bosch has insufficient products to fulfil the order or where the products ordered have been discontinued), decline to accept your order or any part of your order. 

You will be bound to purchase any products once you submit an order for processing under this Shop. Orders once accepted cannot be cancelled or varied without the Bosch's written consent. 

Bosch reserves the right at any time and without notice to impose a limit on the amount of products you may purchase. 

Prices

All references to $ and dollars shown within the Shop will be in Australian dollars. All prices are current at the time of publication on the Shop and are exclusive of GST, unless where otherwise stated.

You are responsible for any costs associated with accessing this Shop and for submitting an order, including any internet service provider fees and all telephone call charges.

Installation

You can choose to use the installation services provided by Bosch’s preferred installation provider. To initiate these services, you can request a site visit upon purchase of an EV charger from the Shop. A site visit fee will be charged by Bosch during the checkout process.

Bosch will provide the customer with the earliest date available for the installation provider to come to your nominated address to conduct a site visit. The installation provider will contact you to arrange the site visit.

The site visit is to assess the feasibility of installing the EV product(s) purchased from the Shop and may include inspections of the electrical infrastructure by Bosch’s preferred installation provider to provide an assessment and quotation. You must ensure that the site is accessible at the scheduled time of the visit and must coordinate this with the installer.

You must provide accurate details to the installer regarding the property and electrical system prior to the site visit.

If you elect to proceed with the installation provider’s quotation, then an amount equal to the site visit fee (paid to Bosch during the Shop checkout) will be deducted from the final cost of your installation.

You may cancel or amend your site visit booking no later than 5pm, 2 business days before the scheduled booking and have your site visit fee refunded. Any cancellations after this time are non-refundable.

Delivery and Returns

Delivery

Shipping is free for all products purchased from this Shop and we will endeavour to effect delivery within 2-4 days, depending on location. A signature will be required for all deliveries. Anyone at the delivery address who receives the products shall be presumed by Bosch to be authorised to receive the products. 

If you use this Shop, you warrant that all information provided in your order is accurate, complete and up to date. 

Returns

Terms relating to returns are outlined in Bosch’s Terms of Delivery and Sale, under Section 6 Notification of Faults and Returns.

Your conduct 

You must not:

• use the Shop in breach of any applicable laws or regulations;
• interfere with, disrupt, or create an undue burden on the Shop; or
• upload, post, transmit or otherwise make available any material that are not your original work, or which may infringe the intellectual property or other rights of another person.

Bosch reserves the right to block or suspend any user of its Shop, and to remove any material uploaded on the Shop by any user, without notice. By uploading any material via any aspect of the Shop, you grant Bosch a non-exclusive, worldwide, royalty-free, perpetual licence to use, reproduce, edit and exploit the material in any form and for any purpose, and unconditionally waive all moral rights as defined by the Copyright Act 1968. 

Australian Consumer Laws

You are advised that your use and your purchase of any products from this Shop may be subject to the consumer law provisions contained in the Competition and Consumer Act 2010 (Cth) (Act). You may have certain rights and remedies under the Act that cannot be excluded or modified. These Terms and Conditions are to be read subject to any such rights or remedies under the Act.
